1. Acceptance of Terms
By accessing or using the Kaiju platform ("Service"), including any associated websites, APIs, tools, and dashboards operated by Kaiju ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
We may modify these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
Kaiju provides contributor intelligence tools for cryptocurrency and web3 project teams. The Service aggregates and analyzes publicly available data from social media platforms (including X/Twitter and Discord), code repositories, and third-party quality providers to generate contributor scores, rankings, and analytics.
The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. Eligibility and Accounts
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
Access to certain features requires an account with an access code provided by Kaiju or a project administrator. You are responsible for maintaining the confidentiality of your access credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service to harass, abuse, or harm any individual or community
- Attempt to manipulate or game scoring algorithms through artificial engagement, fake accounts, or coordinated inauthentic behavior
- Reverse-engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or use automated means to access the Service beyond what is provided through our APIs
- Share your access credentials with unauthorized third parties
- Use the Service in any manner that violates applicable laws or regulations
5. Data and Content
The Service processes publicly available data from third-party platforms. We do not claim ownership of this data. Contributor scores, analytics, and derived insights generated by the Service are provided for informational purposes and should not be the sole basis for any legal, financial, or employment decisions.
Project administrators retain ownership of their project configurations, custom scoring parameters, and any data they upload to the Service. We claim no ownership rights over project-specific data.
5A. Data Protection and GDPR
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable data protection laws. Full details of our data processing practices, lawful bases, data subject rights, and sub-processor list are described in our Privacy Policy.
The Service processes publicly available social media data about individuals ("contributors") who may not have a Kaiju account. This processing is carried out under the lawful basis of legitimate interest (Article 6(1)(f) GDPR). Contributors have the right to access, rectify, erase, restrict, port, and object to the processing of their personal data at any time.
By using the Service as a project administrator, you acknowledge that:
- You act as a joint controller (or independent controller, depending on the arrangement) with respect to contributor data processed under your project
- You are responsible for ensuring your use of contributor scores complies with applicable data protection laws in your jurisdiction
- If you enable public leaderboards, you accept responsibility for the public disclosure of contributor usernames and scores
- You will cooperate with Kaiju in responding to data subject rights requests that relate to contributors tracked under your project

6. Third-Party Services
The Service integrates with third-party platforms including X/Twitter, Discord, GitHub, and various analytics providers. Your use of these platforms is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.
Changes to third-party APIs, rate limits, or terms of service may affect the availability or functionality of certain Kaiju features. We will make reasonable efforts to adapt to such changes but make no guarantees of uninterrupted service.
7. Intellectual Property
The Service, including its scoring algorithms, user interface, documentation, and brand assets, is the property of Kaiju and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the Service as permitted herein.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Contributor scores and analytics are derived from publicly available data and algorithmic analysis. We make no guarantees regarding the accuracy, completeness, or reliability of any score, ranking, or insight generated by the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIJU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless Kaiju, its affiliates, officers, directors, and employees from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
